JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION





1. Contracting Office - Defense Commissary Agency, CCQE (Enterprise) Division, 1300 East

Aye, Fort Lee, VA 23801





2. Type of Contract Action - This J&A will be a 6-month extension modification for the current

services requirements contract HDECO5- 18-D-000 1. The modification will extend the period of

performance from May 1, 2023 to October 31, 2023. The contract type is a requirements contract.

The modification will increase the estimated contract value by $88,105.50 for a new total estimated

contract amount of $944,527.13.





3. Description of Supplies/Services -This action is for the management and assorted linen

products and services to four (4) commissaries within Colorado.





4. Authority Cited - The statutory authority permitting other than full and open competition that

is applicable to this Justification and Approval (J&A) is 41 USC 1901/FAR 13.106-1(b)(1)(i);

Contracting officers may solicit from one source if the contracting officer determines that the

circumstances of the contract action deem only one source reasonably available (e.g., urgency,

exclusive licensing agreements, brand-name or industrial mobilization).





5. Reason for Authority Cited - Delays in the procurement process can be attributed to various

reasons. Over the past year, there have been personnel changes, at both the Contract Specialist

and Contracting Officer levels for this acquisition. Additionally, due to contractual issues with

other linen contracts, it was discovered the Statement of Work (SOW) needed to be rewritten to

improve the requirements for future acquisitions. In the past, the Enterprise Contracting

Division was responsible for the SOW. Efforts were made in conjunction with Store Operations

to appoint a Commissary Management Specialist to serve as the primary point of contact and

requiring activity for linen services. The SOW was finalized approximately December 2022;

however, minor edits were made March 9, 2023. Due to the SOW changes, more time is needed

to complete the pre-award process. At this time, an award to any other source at this time would

result in unacceptable delays in fulfilling the requirement and an interruption of services. In the

absence of these services, the commissary operations may be interrupted and the military

members and their families will be denied their full commissary benefit provided to them by

statue under 10 USC §248 1 and 10 USC §2484.





6. Efforts to Obtain Competition - The justification in support of the agency's request not to

issue a sources sought notice is predicated upon the fact that the required services are deemed to

be available only from the incumbent contractor. Goodwill Industrial Services Corporation has been

performing the services at a satisfactory level for the past year. DeCA fully intends to solicit the

follow-on action as full and open competition.





7. Fair and Reasonable Cost Determination - A modification will be done for 6 months. A

proposal will be requested from the contractor for the 6-month J&A period of performance. In

accordance with FAR Part 13, the following techniques will be used to determine fair and

reasonableness: Comparison ofproposed prices with independent Government cost and Analysis

of data other than certified cost or pricing data provided by the offeror.





8. Market Research - As indicated above, an award to any other source at this time would result

in unacceptable delays in fulfilling the requirement and an interruption of services.





9. Actions to Increase/Foster Competition - The current contract was awarded using Full and

Open competition. This justification is limited in scope to cover only the period of time needed to

prevent a gap in services until the agency can competitively award a follow-on contract. Based on

market research for the follow-on action, the agency anticipates to adequate competition and a Full

and Open competition.
